U.S. Senator Tim Scott of South Carolina, alongside Senator Bill Hagerty from Tennessee and Congressman Andy Biggs of Arizona, has publicly criticized U.S. Attorney General Merrick Garland over the Department of Justice's handling of illegal aliens registering to vote in American elections. They expressed concern about reports of non-citizens participating in federal elections and noted a lack of response from the DOJ to their inquiry sent on July 12, 2024.

"We are deeply concerned by reports of non-citizens registering to vote and voting in federal elections," the Members of Congress wrote. "As of today, there has been no response from you or your Department regarding the inquiry on July 12, 2024, seeking information on efforts undertaken by your Department to enforce laws prohibiting non-citizen voting."

The issue is pressing as the presidential election approaches in less than 34 days. The letter highlighted that states such as Virginia and Texas have seen cases emerge since the initial inquiry was sent.

"Clearly, there is a non-negligible amount of voter participation by non-citizens in federal elections," they continued.

The letter requested detailed information from the DOJ by October 16, 2024, including data on prosecutions under specific U.S.C sections related to illegal voting and registration by non-citizens since January 20, 2021. It also sought details on how allegations are investigated and what steps are taken to prevent such occurrences.

The letter was co-signed by numerous Senators including Tommy Tuberville (R-Ala.), Marsha Blackburn (R-Tenn.), Roger Marshall (R-Kan.), among others. Additional support came from Representatives like Andy Harris (R-Md.), Clay Higgins (R-La.), Gary Palmer (R-Ala.), and many more.
