Attorney General urges consumer action on $39 million Apotex drug price settlement

Attorney General Alan Wilson is encouraging consumers to verify their eligibility for compensation related to certain generic drug purchases. This comes as South Carolina, along with 50 other states and territories, seeks preliminary approval for a $39.1 million settlement with Apotex, a generic drug manufacturer accused of conspiring to inflate prices and limit competition.

Previously announced last fall by Attorney General Wilson and the multistate coalition, the settlement with Apotex was contingent on receiving necessary signatures from all involved states and territories. With those signatures now secured, the coalition has filed the settlement in U.S. District Court for the District of Connecticut in Hartford.

Consumers who bought any of the specified generic prescription drugs between May 2009 and December 2019 may be eligible for compensation. For more information on eligibility, individuals can call 1-866-290-0182 (Toll-Free), email [email protected], or visit www.AGGenericDrugs.com.

The settlements address allegations that both Apotex and Heritage Pharmaceuticals participated in extensive conspiracies to artificially raise prices, limit competition, and unreasonably restrain trade regarding various generic prescription drugs. As part of these agreements, both companies have agreed to cooperate with ongoing multistate litigations against 30 corporate defendants and 25 individual executives. They have also committed to implementing internal reforms aimed at ensuring fair competition and adherence to antitrust laws.

The announcement includes participation from Alaska, Arizona, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland Massachusetts Michigan Minnesota Mississippi Missouri Montana Nebraska Nevada New Hampshire New Jersey New Mexico New York North Carolina North Dakota Northern Mariana Islands Ohio Oklahoma Oregon Pennsylvania Rhode Island South Carolina South Dakota Tennessee Utah U.S Virgin Islands Vermont Virginia Washington West Virginia Wisconsin Wyoming Puerto Rico.
