Governor McMaster advocates for liability reform in state address

South Carolina's small business community has expressed support for Governor Henry McMaster's recent call for reform in the state's joint and several liability laws. During his State of the State address, McMaster emphasized the need to adjust these legal frameworks, which many believe currently disadvantage defendants, including small business owners.

Ben Homeyer, State Director of the National Federation of Independent Business (NFIB), commented on the governor's commitment. "Our small business members were glad to hear Governor McMaster’s commitment to passing joint and several liability reform this session," Homeyer stated. He highlighted concerns that South Carolina's civil justice system is eroding its reputation as a favorable environment for small businesses.

Homeyer further explained, "We agree with Governor McMaster that small businesses shouldn’t be penalized for someone else’s mistake just because they might have more money." He pointed out the financial burden on small businesses when facing lawsuits, where defending against even frivolous claims can be costly enough to threaten their survival.

The NFIB is eager to collaborate with both Governor McMaster and legislative leaders in advancing these reforms during this year's General Assembly session. "NFIB looks forward to working with Governor McMaster and legislative leaders to pass joint and several liability reform during this year’s session of the General Assembly," Homeyer added.
