A federal court denied recent pushes by the South Carolina governor and attorney general to reinstate bans on mask mandates in public schools. | File
A federal court denied recent pushes from Gov. Henry McMaster and State Attorney General Alan Wilson to reinstate bans on mask mandates in the state school system.
McMaster and Wilson attempted to challenge a federal ruling that previously gave school districts to make the final decisions regarding mask requirements, but were ultimately rejected by the U.S. Fourth Circuit Court of Appeals, according to the Greenville News.
“The 4th U.S. Circuit Court of Appeals has rejected Gov. Henry McMaster and State Attorney General Alan Wilson's challenge to a federal ruling that allowed school districts to require masks," State Sen. Marlon Kimpson tweeted.
Among other reasons, the court said McMaster and Wilson failed to comply with the rules of the process of appeals, and needed to first seek a stay on the ruling within a district court before seeking out the circuit court of appeals, according to the Greenville News.
While the proviso regarding the mask mandates says state funds cannot be used by school districts as part of the requirements, some school districts claimed the proviso "tied their hands," according to Greenville News.
