South Carolina Attorney General Alan Wilson announced a legal victory after the state’s Supreme Court upheld the 2023 Fetal Heartbeat and Protection from Abortion Act. The decision dismissed Planned Parenthood’s challenge, affirming that the state legislature acted within its constitutional rights to regulate abortion at around six weeks of pregnancy.
“This ruling is a resounding win for the rule of law and protecting the unborn in South Carolina,” stated Attorney General Wilson. “Today’s decision reaffirms that our elected legislators, not out-of-state interest groups, hold the power to shape South Carolina’s policies in accordance with the values of its people.”
The court ruled that the act bans abortion at a specific biologically identifiable moment, typically occurring at approximately six weeks of pregnancy unless exceptions apply.
Wilson commended his office’s litigation team and emphasized his ongoing dedication to defending laws enacted by the General Assembly. “We will continue to stand for life, defend the law, and fight for the will of South Carolinians in every courtroom,” he added.
