The National Federation of Independent Business (NFIB) has expressed gratitude to the South Carolina Senate for reaching an agreement on a key piece of legislation concerning lawsuit abuse. Ben Homeyer, NFIB State Director, commended the Senate leadership for their action in promoting fairness in the state’s civil justice system.
S.244, the bill in question, passed its second reading with a vote of 35-7 on Wednesday night and is set to receive a final reading today before progressing to the House of Representatives.
“This is important legislation with strong advocates on both sides,” Homeyer remarked. He further acknowledged the efforts of Senator Shane Massey and other Senate leaders, noting their dedication to reducing lawsuit abuse. The proposed changes are anticipated to lower insurance costs and ensure equitable compensation for small businesses.
“S.244 puts in numerous protections for businesses that the current law does not,” Homeyer explained, highlighting that the bill’s impact extends across various sectors including the hospitality, construction, and transportation industries.
“You shouldn’t be targeted for a lawsuit simply because some trial lawyer thinks you have the deepest pockets,” Homeyer asserted. He emphasized the financial vulnerability of small businesses, pointing out how the burden of even one frivolous lawsuit could be detrimental to their operations.
Homeyer concluded by commending the legislative leaders for their awareness of the obstacles faced by small businesses in South Carolina’s legal system and expressed hope for a prompt approval in the General Assembly.
