U.S. Senator Tim Scott, alongside Senator James Lankford and Congresswoman Virginia Foxx, introduced the Families’ Rights and Responsibilities Act in Washington on January 23, 2025. The proposed legislation aims to safeguard parents’ rights to direct their children’s upbringing, education, and healthcare by implementing a strict scrutiny test.

Senator Scott emphasized the importance of parental involvement, stating, “Parents have a fundamental right to control the upbringing of their child, whether it’s in the classroom or at home.” He expressed concern that parents are increasingly being excluded from crucial aspects of their children’s lives.

Congresswoman Foxx echoed these sentiments: “Parents deserve to raise their children without the looming threat of government infringement.” She added that the act would serve as a check against governmental policies that do not respect parental decision-making.

Alliance Defending Freedom Senior Counsel Matt Sharp supported the bill’s introduction. He stated that parental rights have been compromised by government actions and praised Senators Scott and Lankford along with Representative Foxx for stepping up to protect these rights. “This bill rightfully restrains federal government overreach,” said Sharp.

The bill has garnered support from several other lawmakers including Senate Republican Whip John Barrasso and Senators Kevin Cramer among others. It also has backing from Representatives Randy Weber, John Rose, Mary Miller, Gus Bilirakis, Clay Higgins, Brett Guthrie, Brad Finstad, Barry Loudermilk, Rich McCormick, and Mike Haridopolos.

The act addresses concerns stemming from previous administration proposals under Title IX regulations which could have required schools to treat boys as girls and vice versa without notifying parents. The legislation seeks to provide legal recourse for parents against such perceived violations of their rights.
