South Carolina Attorney General Alan Wilson has joined 22 other state attorneys general in urging the U.S. Supreme Court to hear a case challenging California’s Proposition 12. This law enforces stringent animal welfare regulations on pork producers nationwide, regardless of their state of operation.
Attorney General Wilson expressed his concerns, stating, “California’s Californication of our food supply is out of control—first, they come for pork, next, they’ll have us eating crickets. Proposition 12 is nothing more than a power grab by coastal elites who want to dictate how the rest of America farms, eats, and does business. South Carolina won’t stand by while they force their radical agenda on the entire country.”
The brief filed by the coalition argues against Proposition 12, with Wilson asserting that “the Constitution was designed to prevent exactly this kind of economic balkanization.” He warns that if Proposition 12 remains in effect, it could lead to states imposing their own regulatory measures on others, causing disruption in national markets.
The group of attorneys general is appealing to the U.S. Supreme Court to review the Ninth Circuit’s decision not to address significant constitutional issues highlighted by the petitioners. They believe that Supreme Court intervention is necessary to define state power limits and maintain principles of free and fair interstate commerce.
